SmartAlex Recording Consent Notice

1. What this notice covers

This Recording Consent Notice (the "Notice") explains how the SmartAlex Recorder, the native Mac application offered by THERCSGROUP PTE. LTD., trading as SmartAlex ("SmartAlex", "we", "our", or "us"), records meetings, and it sets out your responsibilities when you record. It supplements our Privacy Policy and Terms of Service. Where there is a conflict, the more specific provision applies.

2. How the recorder works

The SmartAlex Recorder runs on your own Mac. When you start a recording, it captures your computer's audio and your microphone. No bot joins the call, and nothing in the meeting tells the other participants that a separate service has joined, because none has. Because capture is local, the recorder works for video calls on any platform and for in-person conversations alike.

When the recording ends, the audio is sent to SmartAlex for processing in the same way as any other meeting on your account. We produce a transcript, a summary, and action items, and they appear in SmartAlex under Meetings.

3. Your responsibility to inform and obtain consent

You are responsible for the meetings you choose to record. Before you record, the app asks you to confirm that you are authorised to record the meeting and that you will let the other participants know it is being recorded. By starting a recording you confirm both of those things.

Recording laws differ from place to place. Some jurisdictions allow recording with the consent of one party to the conversation. Others require the consent of every party. The following are examples of all-party-consent jurisdictions in the United States: California, Florida, Illinois, Maryland, Massachusetts, Montana, Nevada, New Hampshire, Pennsylvania, and Washington. Many countries outside the United States, including jurisdictions in the European Union, the United Kingdom, and elsewhere, also require that participants be informed before a recording begins. You are responsible for knowing and following the rules that apply to you and to the people you are meeting with, and for obtaining any consent those rules require.

4. What is captured, and what is not

The recorder captures the audio of the meeting (your computer's audio and your microphone) and any notes you choose to type during the meeting. It does not capture your screen contents, and it does not run when you have not started a recording. You start and stop each recording yourself from the menu bar.

5. Where your recordings go and how long they are kept

Recordings, transcripts, summaries, and the related notes are stored in your SmartAlex account and are visible to the people in your workspace who have access to your Meetings, in line with your workspace settings. Retention follows your workspace configuration. You can delete a meeting and its recording from SmartAlex at any time.

6. Records we keep of your consent

When you confirm the consent statement and start recording, we keep a record that you accepted it, together with the exact wording you accepted and the time you accepted it. This record exists so that both you and we can show that the confirmation was given. It does not contain the contents of your meetings.

7. Updates and contact

We review this Notice from time to time and update it to reflect changes in the app or in the law. The Effective Date below reflects the most recent revision. If you have questions about recording or about your data, contact privacy@getsmartalex.com.
