The Services operating at getsmartalex.com and related domains, mobile applications, and APIs are operated by THERCSGROUP PTE. LTD. (trading as SmartAlex), a private company limited by shares incorporated in the Republic of Singapore.

In this notice, SmartAlex, we, us and our mean THERCSGROUP PTE. LTD. trading as SmartAlex. Services means the SmartAlex platform, websites, applications and APIs. Personal Data means information relating to an identified or identifiable individual.

3. Directors
The directors of THERCSGROUP PTE. LTD., as registered with the Accounting and Corporate Regulatory Authority of Singapore ("ACRA"), are responsible for the operation of the Services. The current directors are recorded in the company's ACRA filings, which form the authoritative public register. We do not maintain a separate director list in this notice so that the public register remains the single source of truth.
4. Data protection contact
SmartAlex has designated an individual responsible for data protection, as required under Section 11(3) of the Singapore Personal Data Protection Act and, where applicable, under Article 37 of the General Data Protection Regulation. The business contact for that function is privacy@getsmartalex.com. The same address handles requests under the GDPR, the UK GDPR, the Protection of Personal Information Act (POPIA) and other applicable data protection laws.
5. EU representative under GDPR Article 27
SmartAlex is established in Singapore and offers the Services to business Customers, some of whom interact with individuals in the European Economic Area through the Services. Where Article 27 of the General Data Protection Regulation applies, a controller or processor without an EU establishment must designate a representative in the European Union and publish its identity and contact details.
SmartAlex is in the process of appointing an EU representative under Article 27. Until that appointment is completed, you may send written representations to privacy@getsmartalex.com, and we will route them to the appropriate function. On completion, the representative's legal name and EU address will be published in this section.
6. UK representative under UK GDPR Article 27
Where Article 27 of the UK GDPR applies, a controller or processor without a UK establishment must designate a representative in the United Kingdom and make its identity and contact details readily available to data subjects.
SmartAlex is in the process of appointing a UK representative under Article 27. Until that appointment is completed, you may send written representations to privacy@getsmartalex.com, and we will route them to the appropriate function. On completion, the representative's legal name and UK address will be published in this section, in the same way as the EU representative above.
7. Swiss representative under the FADP
Where Article 14 of the Swiss Federal Act on Data Protection (FADP) applies, a controller domiciled abroad must designate a representative in Switzerland in the circumstances set out in that Act.
SmartAlex is in the process of confirming whether a Swiss representative is required and, where it is, appointing one. Until any such appointment is completed, you may send written representations to privacy@getsmartalex.com. The Swiss Federal Data Protection and Information Commissioner (FDPIC) is the supervisory authority for data protection in Switzerland. On completion of any appointment, the representative's legal name and Swiss address will be published in this section.
8. Roles in relation to personal data
For the call content, transcripts and contact data that a Customer or its End Users provide or generate through the Services, SmartAlex acts as the Customer's Processor and processes that data on the Customer's instructions. For account, billing, security and product-analytics data, SmartAlex acts as an independent Controller. How we handle Personal Data is described in our Privacy Policy, and our processing on behalf of Customers is governed by our Data Processing Addendum.
9. Online dispute resolution
The European Commission's online dispute resolution platform (formerly at ec.europa.eu/consumers/odr) was retired on 20 July 2025 under Regulation (EU) 2024/3228. SmartAlex is not obliged to participate, and does not currently participate, in alternative dispute resolution proceedings before consumer arbitration bodies. This does not affect any statutory right you may have to complain to a supervisory authority, including the Singapore Personal Data Protection Commission, the South Africa Information Regulator at complaints.ir@inforegulator.org.za, or your local supervisory authority in the EU or UK.
10. Liability for content and links
SmartAlex makes commercially reasonable efforts to keep the content of the Services accurate and up to date, but does not warrant the accuracy, completeness or timeliness of the information provided. The Services may contain links to external websites operated by third parties. SmartAlex does not control those websites and is not responsible for their content. The operators of the linked pages are solely responsible for their content.
11. Copyright and trade marks
The content and works on these pages, including the SmartAlex name, logos, marks and product designs, are protected by Singapore and international copyright and trade mark law. Reproduction, adaptation, distribution and any other exploitation outside the limits of copyright require the prior written consent of SmartAlex.
12. Governing law and jurisdiction
This Imprint and your use of the Services are governed by the laws of the Republic of Singapore, without regard to its conflict of law rules, except where mandatory consumer protection law in your country of residence applies. Disputes are subject to the dispute resolution provisions in our Terms of Service. Nothing in this Imprint or those Terms limits the statutory rights of an individual, including the right to bring a complaint before a competent supervisory authority, which are separate from any commercial dispute resolution mechanism.
13. Updates
This Imprint is reviewed at least once a year and on any material change to the operator entity, its registered office, its contacts, or its data protection representatives. The effective date below reflects the most recent revision.
